Community Association

How is the Community managed?

Lend Lease held in NSW under Community Title is regulated by the Community Land Management Act 1989.  Similar to an Owners’ Corporation in a Strata Title development, Precinct and Community Associations make decisions on behalf of the community.  The regulatory requirements for these associations are co-ordinated by a Community Managing Agent, (ClubLINKS NSW at Bingara Gorge) who ensure the requirements of the Community Management Statement, Precinct Management Statement and Building & Siting Requirements are upheld to maintain the character of Bingara Gorge and protect residents’ investments.

When buying within a community scheme, the lot owner enters into an agreement with the Community Association to comply with the Community Management Statement and the Building  & Siting Guidelines.  In the event of a dispute with the Precinct and/or Community Associations, the lot owner may apply to the Commissioner for Fair Trading for mediation and resolution.

Building and Siting Requirements

The Bingara Gorge Building and Siting Guidelines are a form of positive covenant to ensure the quality of homes and landscaping constructed within the community.  These are available at the Sales and Information Centre and online at the Bingara Gorge Community Portal.  Building & Siting Requirements provide guidelines on such areas as building materials and styles, fencing, landscaping and ancillary structures.  These vary slightly depending on the precinct and the size of the lot.

Community Levies

As with Strata Title ownership, residents will pay a quarterly contribution towards the maintenance and recurrent costs of the community facilities and services.  Each home owner’s levy is based on unit entitlements which in turn are based on land value.  Owners with higher unit entitlements also have proportionally higher voting rights in precinct decisions.  At Bingara Gorge, Lend Lease is paying the Community Levy on behalf of residents until July 2012.

An estimate of community levies is available from the Bingara Gorge Sales & Information Centre, on 4630-0300.  These may change based on each lot’s actual unit entitlements, CPI adjustments and final facilities, services, maintenance and operational costs incurred by the Community Association.
